These Terms of Service (“Terms”) govern access to and use of the Godcaster platform, including its websites, web applications, players, dashboards, APIs, analytics, and related services (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms. If you are using the Platform on behalf of an organization, you represent and warrant that you have authority to bind that organization.
- Who We Are and What We Do
Godcaster is a fully featured web-based platform that enables organizations to organize, distribute, and present spoken-word audio and video content through their own websites, applications, and digital channels.
The Platform operates within the open, standards-based podcast ecosystem and works with RSS feeds. Godcaster parses RSS feeds and facilitates the delivery of episodes from the original content source to end users (“Listeners”).
Godcaster may provide access to a curated selection of Christian and family-friendly podcasts for demonstration or starter use at no cost. Availability of such content may change at any time and does not grant ownership or control rights.
Godcaster is a technology service provider, not a publisher, broadcaster, or editor of user content. Godcaster does not control, endorse, or assume responsibility for content distributed through the Platform.
- Eligibility and Account Authority
You must be legally capable of entering into this agreement. If you are acting on behalf of an organization, you represent that you have authority to do so.
You are responsible for:
- All activity occurring under your account
- Maintaining the confidentiality of login credentials
- Promptly notifying Godcaster of any unauthorized access or security breach
- License to Use the Platform
Subject to these Terms and payment of applicable fees, Godcaster grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your internal business or ministry purposes.
No rights are granted except as expressly stated in these Terms.
- Definitions
“Content” means any and all audio, video, RSS data, text, images, graphics, artwork, metadata, comments, or other materials that you or authorized third parties submit, transmit, store, exchange, distribute, or make available through the Platform.
“Listeners” means end users who access or consume Content distributed through the Platform.
- Content Ownership and Rights
6.1 Ownership
You retain all ownership rights in and to your Content. Godcaster does not claim ownership of any Content provided by you or your authorized contributors.
6.2 Limited License to Godcaster
You grant Godcaster a non-exclusive, worldwide, royalty-free license to host, process, transmit, and distribute your Content solely as necessary to provide the Platform and services you request.
This license terminates when your Content is removed from the Platform, except as required for legal compliance, dispute resolution, or routine backups.
- Responsibility for Content
You are solely responsible for your Content and represent and warrant that:
- You own or have secured all necessary rights to distribute the Content
- The Content does not infringe intellectual property or other legal rights
- The Content complies with all applicable laws and regulations
Godcaster does not review, approve, or edit Content and is not responsible for its substance.
- Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law or regulation
- Distribute malware, malicious code, or abusive traffic
- Interfere with or disrupt Platform operations
- Misrepresent ownership, affiliation, or authorization
- Attempt unauthorized access to systems, data, or accounts
Godcaster may suspend or terminate access for violations of this section.
- Copyright and Intellectual Property Infringement (DMCA)
Godcaster respects the intellectual property rights of others and expects users of the Platform to do the same.
In appropriate circumstances and in its sole discretion, Godcaster may suspend or terminate access for users suspected of infringing the intellectual property rights of others. Godcaster may also remove or disable access to material that is alleged to be infringing.
DMCA Notice Procedure
In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512), Godcaster will respond promptly to properly submitted notices of alleged copyright infringement.
If you believe your copyrighted work has been infringed, please submit a written notification that includes substantially the following:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner
- Identification of the copyrighted work claimed to have been infringed (or a representative list)
- Identification of the material claimed to be infringing and information reasonably sufficient to locate it
- Contact information (address, telephone number, and email address)
- A statement of good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and authorized
Notices should be submitted via the Contact Us link on the Godcaster website. Notices that do not substantially comply may not receive a response.
- Third-Party Services
The Platform may integrate with or distribute Content through third-party services, including podcast directories, app platforms, and payment processors.
Godcaster is not responsible for the availability, policies, or actions of third parties. Third-party terms may apply.
- Fees, Billing, and Renewal
Fees, billing cycles, and subscription terms are set forth in your applicable order or plan.
Unless otherwise stated:
- Fees are non-refundable
- Subscriptions renew automatically unless cancelled prior to renewal
- You are responsible for applicable taxes
Godcaster may modify pricing with reasonable advance notice.
- Data, Analytics, and Insights
Godcaster provides analytics and attribution data based on available signals and third-party inputs. Analytics are provided “as is” and may vary by platform or distribution channel.
You retain rights to your data. Godcaster does not sell listener data except as described in its Privacy Policy.
- Service Availability and Changes
The Platform is provided on an “as available” basis. Godcaster does not guarantee uninterrupted service and may perform maintenance, modify features, or discontinue components of the Platform.
- Termination
You may terminate your account in accordance with your subscription terms.
Godcaster may suspend or terminate access for violation of these Terms, non-payment, or legal requirements. Upon termination, access to the Platform will cease, subject to any applicable data access rights.
- Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GODCASTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
- Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GODCASTER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
- Indemnification
You agree to indemnify and hold harmless Godcaster from claims arising from your Content, use of the Platform, or violation of these Terms.
- Governing Law and Venue
These Terms are governed by the laws of the State of Texas. Any legal action shall be brought exclusively in state or federal courts located in Texas.
- Changes to These Terms
Godcaster may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
